Terms & Conditions - ( Book)

This page tells you the terms and conditions on which we will supply a Mydish Cookbook to you. Please read these terms and conditions carefully before ordering a Mydish Cookbook from our website (our site). You should understand that by ordering a Mydish Cookbook, you agree to bound by these term and conditions.

1. Information about us


1.1 Mydish.co.uk is a site operated by Mydish Ltd. ("We"). We are registered in England and Wales under company number 6136574, trading at 91 Brick Lane, E1 6QL and have our registered office at 53 The Rise, Elstree, Hertfordshire, WD6 3JS. Our VAT number is 911848127

1.2 We are a limited company.


2. Your status

By placing an order through our site, you warrant that you are legally capable of entering into binding contracts and that you are at least 18 years old.

3. How the contract is formed between you and us

3.1 Your order constitutes an offer to us to buy a Mydish Cookbook. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an order confirmation by e-mail. The contract between us (Contract) will only be formed when we send you such order confirmation.

3.2 Our General Terms and Conditions and Privacy Policyare hereby incorporated into these terms and conditions of supply and will also apply to the Contract. Please therefore ensure that you read them carefully. Where there is any conflict between these terms and conditions of supply and the general terms and conditions and privacy policy, these terms and conditions of supply will take precedence

4. Delivery

4.1 Your order will be delivered to the address you give when you place your order, except that deliveries are not made outside the United Kingdom as shown on our site at the time you place your order. If delivery cannot be made to your address, we will inform you in as soon as possible.

4.2 If there is no one at the address given who is competent to accept delivery of the goods, you will be notified of an alternative delivery date or a place to collect the goods.


4.3 Every effort will be made to deliver your order by the delivery date set out in our order confirmation or, if no delivery date is specified, then within 28 days of the date of our order confirmation. However, we will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery. In this case, we will inform you as soon as possible.

4.4 You will become the owner of the Mydish Cookbook(s) you ordered and responsible for risk of loss of or damage to it/them on delivery to you.

5. Description of order

5.1 The quantity of Mydish Cookbook shall be as set out in your order, as accepted by us.

5.2 Any Mydish Cookbook that you order shall be compiled, printed and supplied in accordance with the preview version which you will have approved at step 6 of the Mydish Cookbook compilation process for that book. It is therefore very important that you pay careful attention to the contents and layout of that preview version before you approve it and place your order as changes will not be possible once you have placed your order.

6. Price and payment

6.1 The price of any Mydish Cookbook you order will be as shown on our site at the time you place your order, except in cases of inadvertent error, as to which see clauses 6.4 and 6.5 below.

6.2 The price excludes delivery costs, which will be added to the total amount due as set out in the delivery guide on our site. VAT is not payable.

6.3 Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you an order confirmation.

6.4 It is always possible that, despite our best efforts, some of the prices listed on our site may be incorrect. We will normally verify prices as part of our order confirmation procedures so that, where a price is less than that stated, we will charge you the lower amount. If the correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions, or reject your order and notify you of such rejection.

6.5 We are under no obligation to provide the Mydish Cookbook to you at the incorrect (lower) price, even after we have sent you an order confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing.

6.6 Payment is made through a secure online third party payment system. The credit or debit cards accepted by the third party supplier are those listed on their website and include all major banks and credit card systems.

6.7 We will debit the whole of the price from your payment card at the time of your order. We reserve the right to terminate the Contract with you if we are refused payment.

7. Our refunds policy and cancellation


7.1 You can cancel or change any order within one working day of placing the order by contacting support@MyDish.co.uk

7.2 Since each Mydish Cookbook is personalised and printed to your specification, [after the time stated in clause 7.1 above,] you will not have the right to cancel a Contract. Accordingly, we will be entitled to retain in full the price of the goods debited from your payment card in the event that you do attempt any such cancellation.

7.3 Every effort will be taken to ensure your satisfaction with your Mydish Cookbook. However, if you receive a defective book, you should notify us as soon as reasonably possible and return it to us. We will then examine it and will, at your option, send you a replacement Mydish Cookbook or refund the price of the Mydish Cookbook in question to your payment card.

7.4 Where you request a replacement Mydish Cookbook, we will not require payment of any additional delivery charge in respect of the replacement book. Where you opt for a refund, we will, as soon as possible, refund you the price in full, including a refund of the delivery charges for sending the item to you and the cost incurred by you in returning the item to us. However, where you have ordered more than one Mydish Cookbook, we will not refund the delivery charge for sending the item to you unless you are returning the entire order.


8. Our liability

8.1 You should read our general terms and conditions General Terms and Conditionswhich also deal with issues of liability and which, in particular, explain that we are not responsible for the accuracy and contents of recipes submitted to our site. All such terms, and in particular the provisions explaining the limitation of our liability, shall apply equally to any recipes which you select for compilation in Mydish Cookbook.

8.2 Our liability for losses you suffer as a result of us breaking this Contract is strictly limited to the purchase price of the Mydish Cookbook you purchased and any losses which are a foreseeable consequence of us breaking the Contract. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us. We are therefore not responsible for losses you incur as a side effect of the main loss or damage and which are not foreseeable by you and us (such as loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, waste of management or office time) however arising and whether caused by tort (including negligence), breach of contract or otherwise.

8.3 This does not include or limit in any way our liability:
(a) For death or personal injury caused by our negligence;
(b) Under section 2(3) of the Consumer Protection Act 1987;
(c) For fraud or fraudulent misrepresentation; or
(d) For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

9. Import duty

9.1 If you place an order on our site for delivery outside the UK, it may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

9.2 Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.

10. Written communications and notices

10.1 Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.


10.2 All notices given by you to us must be given to Mydish Ltd support@MyDish.co.uk
We may give notice to you at either the e-mail or postal address you provide to us when placing an order, or in any of the ways specified in clause 10.1 above. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.

11. Variation of terms and conditions of supply

We have the right to revise and amend these terms and conditions of supply from time to time, without notice to you, in relation to future sales. You should therefore check the website prior to each order to ensure that you have read and understood the current version of our terms and conditions of supply.

12. Miscellaneous

12.1 You may not transfer any of your rights under these terms and conditions of supply to any other person. We may transfer our rights under these terms and conditions of supply to another business where we reasonably believe your rights will not be affected.

12.2 If you breach these terms and conditions of supply and we choose to ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the terms and conditions of supply.

12.3 We shall not be responsible for any breach of these terms and conditions of supply caused by circumstances beyond our reasonable control.

12.4 If any of these terms and conditions of supply is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining terms and conditions which will continue to be valid and enforceable to the fullest extent permissible by law.

13. Law and jurisdiction

Contracts for the purchase of Mydish Cookbook through our site will be governed by English law. Any dispute arising from, or related to, such Contracts shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
